Dylan Metzner and Jeffrey Kadavy to speak on Directed Trusts June 11

Estate Planning with Directed Trusts

The Colorado Uniform Directed Trust Act provides great flexibility for trust settlors. In this session, we will discuss when the directed trust structure can be used effectively in crafting an estate plan. We will delve into the particulars of the Act to learn about how a trust director’s powers and duties are established, the directed trustee’s obligation to comply with a trust director’s directions (and liability for doing so), and the extent of the duty of both to monitor and share information with each other and to beneficiaries. To end the session, we will work through a practical planning example: the paradigm of a directed trust with investment powers vested in a professional investment adviser. Presented Dylan H. Faculty

Dylan H. Metzner, Esq., is a member of the Private Wealth practice at Jones & Keller, P.C. He counsels high-net-worth individuals, corporate executives, closely held business owners, and families throughout the United States and internationally with their tax, estate and private wealth planning needs, guiding them through the maze of laws and practical considerations, moving each client closer to achieving goals and resolving outstanding issues.

He focuses on designing plans that put the individual and families’ values and goals first before carrying out plans that preserve wealth through legal structures and innovative strategies, the efficient transfer of property, and the reduction of risk from tax consequences, family conflict and litigation. He also advises clients on tax-advantaged entity structures including family limited partnerships and limited liability companies, dynasty trusts, trusts structured to hold inherited qualified plans such as IRAs and 401K, split interest trusts, grantor trusts, and life insurance trusts.

Clients come to Dylan for a myriad of business planning issues including choice of entity selection, maintenance and business succession planning. In addition, Dylan regularly represents family members, fiduciaries, and beneficiaries in resolving estate and trust-related disputes, including breach of fiduciary duty disputes and contested guardianships and conservatorships.

 

Jeffrey B. Kadavy‘s experience includes almost 20 years of advising high-net-worth individuals regarding complex estate and financial planning needs and administering personal and charitable trusts. In March 2017, Mr. Kadavy and several business partners formed Trail Ridge Wealth Management, Inc. Through its subsidiary, Trail Ridge Trust Company, LLC, the firm provides trust, estate, and other fiduciary services.

Previously, Mr. Kadavy served as a senior vice president in the trust department of a mid-sized regional bank in Denver, and as managing director of trust services for the largest privately held bank in the United States. He earned his Bachelor of Arts degree from Oberlin College and his law degree – with distinction – from the University of Nebraska College of Law. He also graduated with high honors from the American Bankers Association Graduate Trust School and holds the Certified Trust and Financial Advisor (CTFA) designation.

Mr. Kadavy is an active member of the CBA Trust & Estate Section, serving on the Uniform Trust Code and Uniform Directed Trust Act subcommittees of the Statutory Revisions Committee. A lifelong lover of music, Mr. Kadavy is a classically trained tenor who enjoys performing in community and church musical events.
