Senior litigator Tom McMahon recently obtained a unique and significant ruling in a major case in Montana. Tom represents a physician with 33 years of experience who is suing a hospital for improperly ending his career as an OB/GYN. In an extremely rare move, the trial judge ruled in summary judgment as a matter of law that the hospital is liable to the physician for beaching its contract with him. Now the jury trial, scheduled for late August, will focus primarily on damages.


Steve Kabler, co-chair of Jones & Keller’s health law section recently co-authored an article published in the Journal of the Colorado Dental Association discussing the recent changes to HIPAA.

Tom McMahon, a senior litigation shareholder with the firm, recently addressed the Health Law Section of the Colorado Bar Association.  His topic was the statutory medical peer review privilege in Colorado – what, precisely it encompasses and what limitations exist.


The Securities and Exchange Commission announced today that companies can use social media outlets like Facebook and Twitter to make news announcement in compliance with Regulation FD (Fair Disclosure), if investors have previously been told which social media the company will be using, and who’s feed to monitor. Regulation FD requires companies to distribute important news in a manner designed to get that information out to the general public, so that all investors have the ability to get important news at the same time.


 

Midwest Holding Inc. and its wholly owned life insurance company, American Life & Security Corp., have acquired Old Reliance Insurance Company, an Arizona domiciled life insurance company, for $3.3 million.

The City and County of Denver's Tax Amnesty Program (the "Program") for unreported Denver Sales, Use and Occupational Privilege taxes (the "Amnesty Taxes) began October 1, 2011.  The Program applies to businesses and individuals who have any unreported Amnesty Taxes due for any period ending on or before June 30, 2011.
